These terms are the agreement between you and [Company legal name] for using the Kepto iPhone app and this website. Please read them, together with our Privacy Policy, which explains how we handle your information.

- What you save is yours. We only use it to run Kepto and to show anonymous trends like the Sunday drop.
- Use Kepto lawfully, for yourself, and don’t misuse it or other people’s content.
- Kepto Pro renews automatically through the App Store until you cancel.
- Kepto isn’t affiliated with Instagram, TikTok or Facebook.
- You can stop using Kepto and delete your account at any time.

1.Agreeing to these terms
By downloading, accessing or using Kepto, you agree to these terms. If you don’t agree, please don’t use Kepto. If you use Kepto on behalf of an organization, you confirm you’re allowed to accept these terms for it.
2.Who can use Kepto
You must be at least [13] years old, or the minimum age required in your country, to use Kepto. If you’re under the age of majority where you live, a parent or guardian must agree to these terms for you.
3.Your account
Keep your sign-in secure and the information on your account accurate. You’re responsible for what happens under your account, so tell us right away at hello@kepto.app if you think someone else has accessed it.
4.Your content
The links, captions, intents, projects and notes you add to Kepto (“your content”) stay yours. To run Kepto, you give us a worldwide, non-exclusive, royalty-free license to host, store, copy, process and display your content only as needed to provide, secure and improve Kepto — for example, to sync your library, send your digest, show projects to people you share them with, and count saves for the anonymous Sunday drop. This license ends when you delete your content or your account, except for counts already included in a Sunday drop, which don’t identify you.
The posts you save belong to the people who made them. Kepto keeps a link and caption so you can find your way back; it doesn’t give you any rights in that content.
5.Acceptable use
When you use Kepto, don’t:
- break the law or infringe anyone else’s rights;
- use shared projects to harass people or spread harmful, hateful or illegal content;
- access Kepto with bots or scrapers, or interfere with or overload our systems;
- copy, modify, reverse engineer or resell Kepto, except where the law allows this despite these terms;
- try to get around limits, security features or the free plan’s save limit.
6.Other platforms and content
Kepto works with posts from services like Instagram, TikTok and Facebook, but it isn’t affiliated with, endorsed by or sponsored by them. Those names are trademarks of their owners. We don’t control third-party content or websites that saved links lead to, and we aren’t responsible for them. Your use of those services is governed by their own terms.
7.Kepto Pro and payments
Kepto is free to use. The free plan keeps up to 50 saves and includes the Sunday digest. Kepto Pro is an optional subscription that keeps everything you save and adds features such as project due dates and sharing. Prices are shown in the app before you buy.
- Payment is charged to your Apple ID when you confirm the purchase.
- Your subscription renews automatically unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within the 24 hours before the period ends.
- You can manage or cancel your subscription in your Apple ID settings at any time. Cancelling stops future renewals; you keep Pro until the end of the period you’ve paid for.
- If we offer a free trial, any unused part of it ends when you buy a subscription.
- Refunds are handled by Apple under its policies.
If Pro ends: [what happens to saves above the free limit when Pro ends, e.g. they stay viewable but you can’t add more]. If we change Pro’s price, Apple will notify you as its rules require, and you can cancel before the new price applies.
8.Apple App Store terms
If you got Kepto from Apple’s App Store, these additional terms apply:
- These terms are between you and us, not Apple. We, not Apple, are solely responsible for Kepto and its content.
- We grant you a limited, non-transferable license to use Kepto on Apple-branded devices you own or control, as permitted by the Usage Rules in the App Store’s terms.
- Apple has no obligation to provide maintenance or support for Kepto.
- If Kepto fails to meet any warranty that applies to it, you may notify Apple, and Apple will refund the purchase price, if any. To the extent the law allows, Apple has no other warranty obligation for Kepto.
- We, not Apple, are responsible for handling any claims relating to Kepto, including product liability claims, claims that it fails to meet legal or regulatory requirements, and consumer protection, privacy or similar claims.
- If anyone claims that Kepto or your use of it infringes their intellectual property, we, not Apple, are responsible for investigating, defending, settling and discharging that claim.
- You confirm that you aren’t located in a country subject to a US government embargo or designated as “terrorist supporting”, and that you aren’t on any US government list of prohibited or restricted parties.
- You must comply with any third-party terms that apply when you use Kepto, such as your carrier’s.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
9.Our rights
Kepto, Pip and our logos, designs and software belong to us and our licensors and are protected by law. These terms don’t give you any rights in them beyond using Kepto as described here. If you send us feedback or ideas, we may use them without any obligation to you.
10.Ending your use of Kepto
You can stop using Kepto and delete your account at any time from the app. We may suspend or close your account if you seriously or repeatedly break these terms, if the law requires us to, or if we stop offering Kepto; where reasonable, we’ll give you notice and a chance to export your saves first. Sections that by their nature should survive — such as your content license for anonymous counts, disclaimers, limits on liability and governing law — continue after your account ends.
11.Changes to Kepto and these terms
Kepto will keep changing, and we may add or remove features. We may also update these terms. If a change is significant, we’ll tell you in the app or by email before it takes effect. If you keep using Kepto after that, you accept the updated terms; if you don’t agree, you can delete your account.
12.Disclaimers
Kepto is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don’t promise that Kepto will be uninterrupted or error-free, or that reminders will always arrive. Some places don’t allow these exclusions, so they may not all apply to you.
13.Limitation of liability
To the fullest extent the law allows, we won’t be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill. Our total liability for any claim relating to Kepto is limited to [the greater of the amount you paid us in the 12 months before the claim or US$50]. Nothing in these terms limits liability that can’t be limited by law, such as for fraud or for death or personal injury caused by negligence.
14.Indemnity
To the extent the law allows, you agree to cover our reasonable costs, including legal fees, if someone brings a claim against us because of your content or your breach of these terms.
15.Governing law and disputes
These terms are governed by [the laws of the State of Delaware, USA], without regard to its conflict-of-law rules, and disputes will be resolved in [the state and federal courts located in Delaware]. If you’re a consumer, you also keep the protection of the mandatory laws of the country where you live and may bring claims in your local courts. Before filing a claim, please email hello@kepto.app — most problems can be sorted out quickly.
16.General
These terms and our Privacy Policy are the entire agreement between you and us about Kepto. If any part is found unenforceable, the rest stays in effect. If we don’t enforce a right right away, we haven’t given it up. You may not transfer these terms without our consent; we may transfer them as part of a merger, acquisition or sale of assets.
